Former President Trump Seeks Supreme Court Approval for State Guard Personnel in Chicago Area

Judicial Challenge Over Guard Activation
In an urgent petition, the justice department urged the bench to overturn a lower court ruling that had stopped the sending of hundreds of military reserve troops to the Chicago region.
The presiding judge had expressed skepticism about the White House's justification for activating the guard, doubting its reasoning in light of the situation on the ground.
A federal appeals court upheld the initial ruling on Thursday, keeping the stationing on pause while the judicial dispute continues.
Administration's Claims
The solicitor general, speaking on behalf of the White House, wrote in the recent request that government officers have often been “intimidated and targeted” in downtown Chicago and the suburb of Broadview community.
This site is home to an ICE holding center.
The president has earlier deployed state guard personnel to Chicago, Illinois and Portland, Oregon, following previous sendings to LA, Memphis, Tennessee, and Washington DC.
The president has stated that military intervention is necessary to reduce protests and bolster deportation efforts.
Political Resistance
Elected Democrats have pushed back sharply the action, saying that the White House's statements are overstated and partisan in nature.
They charge the administration of abusing his executive power to retaliate against critics.
Court officials have also expressed doubt about the administration’s depiction of the situation.
Regional authorities say that demonstrations over immigration enforcement have been largely modest and calm, challenging the administration's description of “war zone” situations.
Legal Basis
At the center of the conflict is the administration's application of a US code authorizing the commander-in-chief to take control of the military reserve only in cases of rebellion or when “incapable with the federal troops to enforce the laws of the United States”.
The White House insists that the forces are necessary to defend US facilities and agents from protesters.
Current Developments
Earlier this month, the government federalized three hundred members of the state guard of Illinois and directed additional Texas-based troops into the region.
As state authorities denounced the action, the former president intensified his language, demanding the detention of Chicago’s mayor and the governor of Illinois, both Democrats, alleging them of failing to secure immigration officers.
The state of Illinois and the city of Chicago jointly sued the government to stop the deployment.
On October 9, district Judge April Perry, appointed by Joe Biden, handed down a preliminary order blocking the directive.
